Welcome to EOICart.ai. This website and its associated services (the "Service") are owned and operated by Southland Ventures, Inc., d/b/a EOICart.ai ("EOICart," "we," "us," or "our"), located at 333 City Blvd W, 17th Fl, Orange, CA 92868.

By accessing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms of Service. If you do not agree, you must immediately cease use of the Service.

1. NATURE OF SERVICE

EOICart.ai is a technology platform that facilitates the automated request and issuance of ACORD 27 Evidence of Property Insurance forms.

EOICart.ai is not an insurance agency or carrier.

• We provide the software interface between Insurance Agencies, Policyholders (Insureds), and Lenders/Brokers.
• Any insurance document generated through the Service is based on data provided by the relevant Insurance Agency and is subject to the terms, conditions, and exclusions of the underlying insurance policy.

2. USER CATEGORIES & FEES

• Insured Users: Policyholders may request their own ACORD 27 forms for personal use at no cost, subject to identity verification.
• Lender/Broker Users: Lenders, bankers, or mortgage brokers requesting a mortgagee clause update and document issuance are subject to a non-refundable $99.00 USD Processing Fee per request.
• Insurance Agents: Licensed agents who utilize the platform to automate their agency's fulfillment are subject to separate Agency Agreement terms.

3. PAYMENTS AND REFUNDS

• All fees for Lender/Broker requests are processed via Stripe.
• Fees are earned upon the successful generation and delivery of the digital ACORD 27 form.
• No Refunds: Due to the instant nature of the automated fulfillment, all sales are final. If a document contains errors based on incorrect data provided by the User, a new request may be required.

4. ACCURACY OF INFORMATION & AUTHORITY

By submitting a request, you represent and warrant that:

• You have the legal authority to request changes to the mortgagee clause.
• All data entered (Policy Number, Loan Number, Lender Address) is accurate.
• You are not using the Service for fraudulent purposes or to misrepresent an insurable interest.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by California law, Southland Ventures, Inc. shall not be liable for any indirect, incidental, or consequential damages arising from:

• Errors in the underlying policy data provided by the Insurance Agency.
• Failure of a Lender to accept the automated ACORD 27 form.
• Any delay or failure in the automated delivery system.

Our total liability for any claim shall not exceed the amount paid by you for the specific transaction giving rise to the claim (e.g., $99.00).

7. INDEMNIFICATION

You agree to indemnify and hold harmless Southland Ventures, Inc. and its officers, directors, and employees from any claims, losses, or legal fees resulting from your breach of these Terms or your provision of inaccurate or unauthorized data to the Service.

8. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of California. Any legal action or proceeding relating to your access to, or use of, the Service shall be instituted in a state or federal court in Orange County, California.
